Returning Student Housing Application

I, [Student Name], the undersigned, hereby agree to contract for a residential room space as a full-time, degree-seeking student enrolled at Ellsworth Community College. I understand that the Residence Life Contract is in effect for the academic year or the remaining portion thereof. This contract is subject to the following terms and provisions, which supersede any previously published information.
Terms: The term of this contract is for one full academic year, beginning with the fall semester and ending at the conclusion of the spring semester. Room and board rates are set by the IVCCD Board of Directors and will be posted on the ECC Residence Life and Housing website: [http://www.iavalley.edu/ECC/student_life/housing.html](http://www.iavalley.edu/ECC/student_life/housing.html). The Director of Residence Life will consider special requests to a student’s signed Residence Life Contract when submitted by the student. Approved exceptions may include a severe medical or health condition verified by a physician that directly affects residence hall status, marriage (copy of marriage certificate required), residence within a 30-mile radius of Ellsworth Community College with a parent or guardian, or transfer to another institution. All requests must include appropriate verification. The Director’s decision will be final in all cases. This contract will be terminated by the College in the event of suspension or dismissal due to disciplinary or academic reasons. In such cases, the student is responsible for the balance of housing fees for the current term.
Students who leave residence prior to the end of the contract term without approval will be assessed a $600 cancellation fee. All other approved withdrawals may be eligible for a prorated refund according to the following schedule:
End of Week 1: 90% refund | End of Week 2: 85% refund | End of Week 3: 80% refund | End of Week 4 through midterms: 50% refund | After midterms: No refund will be issued

1. The College will agree to provide a bed space based on availability to eligible students who are at least 17 years of age at the time of moving into residence. For those under 18, signature of a parent or guardian is required guaranteeing payment of established charges for the specific school year. 2. The student must maintain a full-time status including a minimum of six credits taken on the Ellsworth Community College campus. Students who need to drop courses and do not meet this status must notify Residence Life and Housing to determine continuation of housing options. 3. The assignment or reassignment of rooms and roommates is an administrative decision of The College. The College has the right to assign a resident to any existing vacancy at any time or for consolidation purposes. 4. A resident who withdraws or is released from residence must vacate within 24 hours. 5. The College reserves the right to inspect student rooms and furnishings in order to maintain health, safety, and maintenance of community standards. 6. The student is subject to all rules and regulations of the Student Handbook, including those in The Guide to Residence Living and ECC COVID-19 policies. All documents are available online and within the Residential Hall Office. 7. Student acknowledges that this Agreement covers only the student’s occupancy in your residence hall. The student may not assign this contract or sublet or transfer possession of the apartment unit or room without the written consent of The College. Student agrees that the person named in this contract is the only person that may occupy the residential suite in accordance with this contract. 8. Utilities and services will be provided and paid for by the College including basic internet, laundry services, water and electric. 9. Student agrees to maintain the move-in condition of their residential suite and common areas within the residential complex. The student shall not install equipment; make alterations or repairs or paint without prior approval of the College. 10. All residents will be held responsible for and billed for defacement or damage to the room, common areas, and furnishings for which he or she is contracted. All residents are responsible for certifying the condition of their room by reviewing and signing the Room Condition Sheet upon check-in. The DRIC will be used for the basis of comparison and charges at check-out. 11. The Residential Complexes will be closed for the winter break and residents will participate in Health & Safety renewals at the Thanksgiving and Spring recess. Residents are required to vacate during closing periods and adhere to residential renewal expectations during recesses. Dates and times are listed in The Guide to Residence Living and online. Exceptions may be made for extenuating circumstances and must be communicated to Residence Life and Housing for consideration. 12. Student will not use, have possession of, or allow controlled substances as defined in Chapter 124 of the Code of Iowa in their suite or within the residential complex. Student will not consume, have possession of, or allow beer or any other alcoholic beverages on the premises regardless of legal age. The use of tobacco products in any form is prohibited in the residential complexes. Student will not engage in nor allow illegal activities in the residential complexes. 13. Students and other occupants of the residential suite or room will not have more than triple occupancy at any one time. All gatherings must be limited to the confines of the student’s Suite. No gatherings or parties will be permitted on the premises, lawn or parking lot. 14. A 19-meal plan is required for all residential students. 15. Hallways and common areas in the Residential Complexes are not to be used as storage space. Any articles left in the hallways and common areas will be removed and disposed of without notice to the student. 16. Students shall not have, possess, or allow highly combustible materials, volatile chemicals, firearms, pellet/airsoft guns, fireworks or other types of explosives or weapons in the Residential Complexes and the ECC Campus. 17. The student is responsible for the room and applicable board charges for the entire academic year or remaining portion thereof. Residents seeking consideration to be release from this contract must submit that request to the Director of Residence Life. 18. It is the Student’s responsibility to lock their suite, and rooms at all times, applicable charges will be applied for lost or missing keys and key cards. 19. Smoke detectors and sprinklers are installed in each unit for fire protection. It is unlawful to tamper with any such unit in any way. 20. The insurance policy of the College does not cover any of the student’s personal property and therefore the student should obtain renters’ insurance to insure the Student’s personal property against loss. 21. Student will indemnify and hold harmless from any and all claims, actions, damages, liabilities and expenses in connection with loss of life, personal injury and property damage arising out of any act or omission to act on the part of the Student, the Student’s agents, family, occupants, guests, invitees or licensees. In the case of fire or casualty damage caused by the Student, the Student shall indemnify the College including, but not limited to, all loss of rents and insurance deductibles. 22. This contract and the residency arising hereunder shall be subordinate to the operation and effect of any mortgage or deed of trust, which may now or hereafter affect the apartment unit and apartment building. This clause is self-operative and no further instrument shall be needed to effectuate the subordination. 23. The College reserves the right to take appropriate action against a resident including the termination of this agreement, if a resident violates College rules or is otherwise a detriment to his/her safety or to the welfare of the residential environment. 24. The College may terminate this agreement by written notice if the student fails to comply with the agreement. The student remains liable for the room and board charges for the remainder of the current term. 25. The parties acknowledge and agree that this Residence Life Contract is not governed by the provisions of the Uniform Residential Landlord and Tenant Law by virtue of Section 562A.5 (1) of the Code of Iowa.
